Pulse Terms of Service

1. Acceptance of Terms

By accessing or using the Pulse application and services (the "Service") provided by Pulse ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (available here). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Pulse is an AI-powered personal executive assistant designed to help you manage emails, tasks, and calendars more efficiently. Features include AI email summaries, auto-reply/completion, calendar management, task lists, email clustering/prioritization, the "Claire" AI agent, focus mode, and meeting coordination (the "Features"). Features may be added, modified, or removed at our discretion.

3. User Accounts

• Registration: To use most features of Pulse, you must register for an account, typically by connecting your Google Account via OAuth.
• Accuracy: You agree to provide accurate and complete information when creating your account and to keep this information updated.
• Responsibility: You are responsible for maintaining the confidentiality of your account credentials (including the security of your linked Google Account) and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Use of the Service

• License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.
• Prohibited Conduct: You agree not to:
  • Use the Service for any illegal or unauthorized purpose.
  • Interfere with or disrupt the integrity or performance of the Service.

5. Google User Data

Your use of Features that interact with your Google Account (Email, Calendar, etc.) is subject to your authorization via Google OAuth. Our access to and use of data obtained from Google APIs is governed by our Privacy Policy (available here) and adheres strictly to the Google API Services User Data Policy, including its Limited Use requirements. We access only the data necessary to provide the Features you use and do not use it for prohibited purposes like advertising or selling data.

6. Intellectual Property

• Our IP: The Service, including its software, design, text, graphics, logos (excluding third-party logos like Google's), and underlying technology, is the property of Pulse or its licensors and is protected by copyright and other intellectual property laws.
• Your Content: You retain ownership of the content you create or manage through Pulse (e.g., emails sent, tasks created). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (e.g., for formatting), and display your content solely as necessary to provide the Service to you.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, RELIABLE, OR SECURE. AI-POWERED FEATURES MAY OCCASIONALLY PRODUCE INACCURATE OR UNEXPECTED OUTPUT; YOU ARE RESPONSIBLE FOR REVIEWING ANY AI-GENERATED CONTENT BEFORE ACTING UPON IT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Pulse BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

9. Termination

• By Us: We may suspend or terminate your access to the Service at any time, with or without cause or notice, particularly if you violate these Terms.

10. Governing Law
